Tour Llama LLC ("Company," "we" or "us") respects your privacy and is committed to protecting it through our compliance with this statement. This Privacy Statement explains the privacy practices of the Company related to your access and use of the website https://tourllama.com (the "Website").

The Website is targeted to individuals in the United States, and we do not monitor the Website for use or access by users from other countries. If you access the Website from other regions, be aware that the privacy practices of the Website may differ from those of your home country. By interacting with the Website, you are accepting the terms of this Privacy Statement. If you do not accept the terms of this Privacy Statement, do not use the Website.

  1. INFORMATION YOU PROVIDE TO US

    "Personal Information" includes information that can be used to identify a unique individual, such as a name, physical address, e-mail address, or telephone number. Some features of the Website ask you to provide us with specific categories of Personal Information in order to enjoy complete functionality. If you do not provide us with the categories of Personal Information requested, your ability to fully interact with the Website may be limited. The features requiring you to provide information to us are described in detail below:

    • When you register with the Website, you must provide your name, date of birth, email, phone number, and address. You may also provide us with a username or password.
    • When you submit a Trip to be posted on the Website, you must provide your name, the name of any employees involved with the Trip, if applicable, an event description, dates, the price, the location, an attendee count, an itinerary, and any additional information which may be requested by the Company.
    • When you register to attend a Trip, you may be required to provide us with additional, event-specific information, such as your emergency contact person, your emergency contact person’s contact information, your passport number and passport name, and your age.
    • When you use the Website for communications with the Company or other users related to the Booking Services, we collect all user correspondence with the Company and other users.
    • We collect information about any Trips you view, register for, or submit to be posted on the Website.

    You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Website, or transmitted to other users of the Website or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other users of the Website. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

    1. Tracking Technologies

      We use cookies and other tracking technologies to personalize your experience, analyze user trends, and improve the Website. These tracking technologies allow us to collect information such as your device type, browser type, time spent on the Website, pages visited, geographic location, and other data. For example, we may not be able to recognize your computer or device, and you may need to login every time you visit.

  3. INFORMATION WE COLLECT FROM THIRD PARTIES

    We also obtain information about the traffic and usage of the Website from third parties, including Google Analytics. These third parties also use cookies and other tracking technologies to capture information about your interactions with the Website. We may also obtain Personal Information about you from third parties, including Google and Facebook, in order to expedite your registration process with the Website. We do not have control over the information that is collected, used, and shared by these third parties.   4. HOW WE USE YOUR INFORMATION

    We may use your Personal Information internally for our own purposes, including to manage and maintain the Website; to operate, provide, or improve our services to you; to analyze your use of the Website; to study trends regarding use of the Website; to comply with our contractual obligations; or to fulfill other legitimate interests.

    If you are an Attendee, we will use your Personal Information in connection with the Booking Services and provide your Personal Information to the Tour Guide of any specific Trip for which you register. If you are a Tour Guide, we will share your Personal Information with any Attendee who has registered for a Trip that you will host.

    We may use your Personal Information to let you know when new content is available on the Website, to alert you to upcoming Trips, and to provide you with any general notices about the Website, the Booking Services, and your account. We may use your Personal Information to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

    We may use the information we have collected from you to enable us to post advertisements to our advertisers’ target audiences. Even though we do not disclose your Personal Information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria. We retain the right to share your Personal Information with third parties in the context of marketing or advertising so that third parties can tailor advertisements directly to you.

    Aside from the instances described above, we will only share your personal information: to comply with the law; to respond to claims; to comply with legal process served on the Company (e.g., a lawful subpoena, warrant, or court order); to protect and defend our rights or property or that of the Website users or the public; in connection with a business transfer, sale, liquidation, acquisition, or merger; and if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure.

  5. DISCLOSURE OF YOUR INFORMATION

    We may disclose Personal Information that we collect or you provide:

    • to our third party payment processor, Stripe, in order to process your payment information;
    • to a Tour Guide of a Trip for which you register, in order to facilitate the Booking Services; furthermore, a Tour Guide of a Trip for which you register may share such information with third party service providers it uses to coordinate the Trip;
    • to an Attendee of a Trip which you submitted to be posted, in order to facilitate the Booking Services;
    • to contractors, service providers, and other third party vendors we use to support our business or to provide other services on our behalf, such as business analytics or fraud prevention;
    • to a buyer or other successor in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Company’s assets or stock, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Company about the Website users is among the assets transferred;
    • to fulfill the purpose for which you provide it;
    • for any other purpose disclosed by us when you provide the information; and
    • with your consent.

    If you are a Tour Guide, the information about any Trip which you submit to be posted, including any Personal Information that is required as part of registration for the Trip (which includes your name, the name of any of your employees hosting the Trip, and your contact information) will be publicly available to any user of the Website. If you submit a review of a Trip or Tour Guide on the Website, your review will be publicly available to any user of the Website.

    In addition, we may disclose information about you to third parties where we have a legitimate purpose for doing so, including: (i) if we are required to do so by law or pursuant to legal process; (ii) in response to a request from law enforcement authorities or other government officials; or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity, including exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

    We may disclose aggregated information about our users and information that does not identify any individual without restriction.

  6. CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

    You have the option to access, correct, or amend the Personal Information you provide to us through your profile settings on the Website. You may modify or delete your account at any time by contacting us at info@tourllama.com.

    If you have provided information which is publicly available, such as certain User Contributions, that information may continue to be publicly available on the Website in connection with your name, even after your account has been deleted.

    The Website contains links to other websites such as social media platforms, Tour Guides’ websites, and other partner websites. These websites are not covered by our Privacy Statement, and we do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. Please review the privacy statements of these websites in order to understand the privacy practices of these third parties.

  7. CALIFORNIA PRIVACY RIGHTS

    California Civil Code Section § 1798.83 permits users of the Website that are California residents to request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes. If you are a child, as defined under applicable law, do not use or provide any information on the Website.
